These visa types are based on a close family relationship with a United States (U.S.) citizen described as an Immediate Relative (IR). The number of immigrants in these categories is not limited each fiscal year. Immediate relative visa types include:
· IR-1: Spouse of a U.S. Citizen
· IR-2: Unmarried Child Under 21 Years of Age of a U.S. Citizen
· IR-3: Orphan adopted abroad by a U.S. Citizen
· IR-4: Orphan to be adopted in the U.S. by a U.S. citizen
· IR-5: Parent of a U.S. Citizen who is at least 21 years old

1. Completed and signed I-130 and G-325 by the petitioner
2. Completed and signed G-325A by the principal applicant or beneficiary
3. Filing fee in the amount of USD420.00 payable to US Department of State
4. Original Certificate of Live Birth of both the petitioner and beneficiary
5. Original Certificate of Marriage, if married
6. Original Certificate of No Marriage (CENOMAR), if unmarried
7. Copy of passport of both the petitioner and beneficiary
8. 4 copies of 2x2 photograph each with white background
9. Proofs of relationship
a. Pictures
b. Letters to and from the petitioner and beneficiary
c. Email correspondence
1. File I-130 application with the mentioned requirements with the United States Citizenship and Immigration Services (USCIS) to certify the relationship between the petitioner and beneficiary.
2. Once the USCIS approves the petition, it is forwarded to the National Visa Center (NVC), an office of the Department of State for processing and documentation. The National Visa Center keeps the file until the priority date becomes current.
3. When the petition is current, NVC sends the beneficiary the Choice of Address and Agent or Agent's Choice Letter or the DS3032. The beneficiary will designate himself, or a relative or a friend or an attorney to receive all correspondence from NVC.
4. Visa fee packet is send to the designated agent for the payment of USD404.00.
5. Packet 3 or the DS230 Packet is send once the visa fee is received by NVC. It is send back to NVC together with the following documents:
a. Copy of valid and current passport
b. Original Certificate of Live Birth
c. Original Certificate of Marriage, if married
d. Original Certificate of No Marriage, if unmarried
e. NBI Clearance
f. 2 copies of 2x2 photographs with case number and specimen signature of the beneficiary at the back
g. Police Clearance from the country where beneficiary lived, worked or stayed for six (6) months or more
h. Completed and signed I-864 or the Affidavit of Support from the petitioner. Another I-864 or I-864A from a co-sponsor is required if the annual income of the petitioner does not meet the annual poverty guideline
i. Individual Income Tax Return
6. Packet 4 or Interview Packet is mailed once documents have been completed and reviewed. Waiting time for Packet 4 normally takes 3 weeks to one (1) month.
7. Beneficiary needs to undergo the physical examination three (3) weeks before the set interview appointment.
8. If physical examination is successful, beneficiary proceeds to the US Embassy for the appointment. If it unsuccessful, St. Luke’s Medical Center will request from the US Embassy another interview appointment for the beneficiary.
9. Immigrant visa is delivered within seven (7) days from the date of appointment.
Processing Time:
Processing time for immigrant visa depends on the relationship between the petitioner and beneficiary and the beneficiary’s age and status. Once the priority date becomes current, 4 months
would be the maximum processing time.
