The fiancé(e) K-1 nonimmigrant visa is for the foreign-citizen fiancé(e) of a United States (U.S.) citizen. The US citizen and beneficiary must get married in the US within ninety (90) days from the date of admission of the beneficiary in the US otherwise, the latter will be removed from US.

Requirements:

1. Completed and signed I-129F and G-325 by the petitioner
2. Completed and signed G-325A by the principal applicant or beneficiary
3. Filing fee of USD350.00
4. Photocopy of passport of petitioner and principal applicant
5. 2 copies of 2x2 photograph each with white background
6. Certificate of No Marriage (CENOMAR), both from the petitioner and beneficiary.
7. Divorce or death certificate of previous spouse
8. Original Certificate of Live Birth of both the petitioner and beneficiary

Procedure:

1. File I-129F application with the mentioned requirements with the United States Citizenship and Immigration Services (USCIS) to certify the relationship between the petitioner and beneficiary.
2. Once the USCIS approves the petition, it is forwarded to the National Visa Center, an office of the Department of State for processing and documentation.
3. When the visa registration is completed and visa number is available, it is forwarded by NVC to the US Embassy where the beneficiary resides and an interview is scheduled.
4. Beneficiary will undergo his physical examination with St. Luke’s Medical Center in Bocobo St. Ermita, Manila.
5. Beneficiary proceeds to the US Embassy for his visa appointment with the consular officer.
6. If interview is successful, visa is issued within 7 working days from the date of interview. Beneficiary can be in the US within a matter of days from the receipt of visa and from the PDOS seminar.
7. If interview is unsuccessful, beneficiary could be facing an indefinite delay to his immigration plans. Criminal records, fraud or misrepresentation are several factors that could delay visa issuance.

Processing Time:
The processing time for fiancé(e) visa is 3-6 months.
