PEZA Visa (Formerly 47A2 Special Non-Immigrant Visa)

Under Sec. 47A2 of the Philippine Immigration Act, a Special Non-Immigrant Visa can be issued to foreign investors by the Secretary of the Department of Justice (DOJ) on the basis on public interest or public policy considerations.

Under Sec. 47A2 of the Philippine Immigration Act, a PEZA Visa can be issued to foreign investors by the Secretary of the Department of Justice (DOJ) on the basis on public interest or public policy considerations. This visa is usually given to foreign employees of Regional Headquarters, Regional Operating Headquarters, or those working for special projects in economic zones.

Some examples of industries invested with public interest are companies engaged in oil exploration, power generation, and infrastructure, and those registered with the Philippine Economic Zone Authority (PEZA) and Board of Investments (BOI).

Requirements:

BOI

  • BOI Application Form;
  • Duly signed undertaking in the form of Board Resolution;
  • An Understudy Information Sheet, Designation of Understudy, and Understudy Training Program (if applicable);
  • Authenticated passport with valid visa;
  • A Secretary’s Certificate authorizing the application of the Special Non-Immigrant Visa (for elective officers);
  • Affidavit of Support from BOI registered company;
  • Company organizational chart; and
  • Resume and bio-data of the foreigner applying for the visa.

PEZA

  • Letter of Request to PEZA on company’s behalf;
  • Authenticated passport with valid visa;
  • A Secretary’s Certificate authorizing the application of the Special Non-Immigrant Visa (for elective officers);
  • Current service contract;
  • Resume and bio-data of the foreigner applying for the visa.

DOJ

  • DOJ application form;
  • Certificate of BOI/PEZA Registration and the terms and conditions;
  • Authenticated passport with valid visa;
  • A Secretary’s Certificate authorizing the application of the Special Non-Immigrant Visa (for elective officers);
  • Current Service Contract (for non-elected positions); and
  • Affidavit of Support from BOI/PEZA registered company.

Procedure:

  1. Apply with the appropriate government agency (e.g. BOI, PEZA, DOA);
  2. The government agency endorses the application to DOJ; and
  3. DOJ approves the application and endorses to the BI for implementation.
